We collect two types of information from users of our Services: "personal information," which is information that can be used to identify you (such as your name, email address, or your phone number), and "aggregate information," which is information that cannot be used to identify you (such as frequency of visits to our Website and your browser type). We collect personal information and aggregate information in the contexts described below.

Important: Bestform is not a "covered entity" or "business associate" under the Health Insurance Portability and Accountability Act of 1996 ("HIPAA"), therefore, HIPAA does not apply to the personal information that you provide to us.

If you choose to share information publicly through our Services, please understand that we cannot control the actions of third parties who could access and collect this information.

In general, we collect information from you so that we can provide our Services, operate our business, and provide information that you request from us.

Information You Provide to Us

Bestform Account:

Registration and User Information. When you register for a Bestform account, we collect information such as your name, phone number, email address, date of birth, and your username and password.

Health and Wellness. We collect information that you share with us and that we infer about your health and fitness and wellness goals, behavioral data, eating and drinking habits, supplement habits, and activity information such as walking steps and sleep data. We also collect your physical details such as your height and weight.

Apple Health and HealthKit Data. If you choose to connect your account to Apple Health (HealthKit), we may collect health and fitness data that you have stored in Apple Health, including but not limited to weight, sleep analysis, active energy burned, step count, heart rate, and other activity or health metrics that you authorize us to access. We access this data solely to provide and improve our Services, including to help you track your health and wellness progress, personalize your experience, and deliver more relevant insights and recommendations through the App. You control which categories of HealthKit data you share with us through your device's Health app permissions. You may revoke access at any time by changing your permissions in your device's Settings under Health > Data Access & Devices. We do not sell HealthKit data to third parties, including advertising platforms, data brokers, or information resellers. We do not use HealthKit data for advertising or marketing purposes. HealthKit data is not shared with third parties except as necessary to provide the Services to you, and only with your prior consent.

Photos. You may optionally provide photos that you submit, such as progress photos. Please do not submit any photos that depict or contain other individuals.

Measured Data. We may collect measured data from your device or connected services, such as heart rate, movement data, temperature data, and respiration data.

Calculated Data. We may derive or calculate data based on information you provide or that we collect, including sleep phases (deep, light, REM, awake), activity levels throughout the day, readiness level, and body mass index (calculated based on height and weight).

Account Activity. We track and collect information and data about your account activity and use of our Services, such as feature usage and consistency streaks.

Referral Data. If you were referred to our Services from a third-party such as a health clinic, we collect data relating to the third-party that referred you. Note, however, we never share your personal information with a third-party that referred you to us.

Bug Reporting. We welcome you to report bugs to us, and we collect information that you submit to us when you report bugs. However, please do not provide any personal, health, or sensitive information in connection with any bug reports that you submit to us.

Chatbot:

When you use our AI-powered chatbot, YVE ("Chatbot"), we collect any information, data, text, photographs, graphics, video, messages, and/or other materials that you provide to us via the Chatbot.

Your Communication with Us:

We collect information when you communicate with us. The specific types of information we collect will depend on the forum in which you communicate with us. For example, if you send us an email, we will collect your email address and the content of your email. You may also participate in surveys and questionnaires, in which case we collect any information that you provide to us in response.

Geolocation:

With your consent, we may collect general location information from your mobile device when you use the App. We use this information to provide location-relevant features and to improve our Services. You may disable location services at any time through your device's settings. We do not collect precise GPS location data.

Shopping and Purchases

When you shop or make a purchase through our Services, we collect information about your purchases, your purchase history, items you view, items you put in your cart, and your wishlist. Some of this information may be associated by us with your account.

When you make purchases, our payment processors collect payment information (e.g. bank account, credit or debit card information, billing address) to process your payment in order to fulfill your orders and provide you with products or services you have requested, in order to perform our contract with you. They also share information with us about your purchases.

Information We Automatically Collect

When you use our Services, we automatically receive and collect information from your device. This information includes the following:

Information about your device, such as the operating system, hardware, system version, the Internet Protocol (IP) address, device ID, and device language.

The specific actions that you take when you use our Service, including but not limited to the pages and screens that you view or visit, search terms that you enter, how you interact with our Services, resources that you open or download, and information about your interactions with other users.

The time, frequency, connection type, and duration of your use of our Services.

Information about your wireless and mobile network connections, such as mobile phone number, service provider, and signal strength.

Information regarding your interaction with email messages, for example, whether you opened, clicked on, or forwarded the email message.

Identifiers associated with cookies or other technologies that may uniquely identify your device or browser (as further described below); and

Pages you visited before or after navigating to our Website.

Cookies and Analytics

Cookies are alphanumeric identifiers that we transfer to your device's hard drive through your web browser to help us identify you when you come to our Website. Like many websites, we use cookies on our Website. For specific information about the cookies that we use related to powering our store with Shopify, see https://www.shopify.com/legal/cookies. We use cookies to power and improve our Website and our Services (including to remember your actions and preferences), to run analytics and better understand user interaction with the Services (in our legitimate interests to administer, improve and optimize the Services). We may also permit third parties and services providers to use cookies on our Website to better tailor the Services, products and advertising on our Website and other websites.

Most browsers automatically accept cookies by default, but you can choose to set your browser to remove or reject cookies through your browser controls. Please keep in mind that removing or blocking cookies can negatively impact your user experience and may cause some of the Services, including certain features and general functionality, to work incorrectly or no longer be available. Additionally, blocking cookies may not completely prevent how we share information with third parties such as our advertising partners.

We may use third parties, such as Google Analytics or other analytics providers, to analyze traffic to our Website. Google Analytics does not create individual profiles for visitors and only collects aggregate data. To disable Google Analytics, please download the browser add-on for the deactivation of Google Analytics provided by Google at http://tools.google.com/dlpage/gaoptout?hl=en. We may also use cookies, pixels, beacons, or other web tracking technologies to track the amount of time spent on our Website or social media and whether or not certain content, such as a video was viewed. We may work with a third party to collect and process this information for us, based on our instructions and in compliance with this Policy.

At the present time our Website does not respond to "Do Not Track" signals or similar mechanisms.

Interest-Based Advertising

We may use third-party advertising services, including but not limited to Meta (Facebook/Instagram) Pixel, to display interest-based advertising to you on our Website, within the App, and on third-party websites and platforms. These services may use cookies, pixels, and similar technologies to collect information about your interactions with our Services and other websites, including your browsing activity, pages visited, and purchases made, to provide you with advertisements that are tailored to your interests.

Meta Pixel. We use Meta Pixel on our Website to measure the effectiveness of our advertising, to deliver targeted advertisements to you on Meta platforms (including Facebook and Instagram), and to create custom and lookalike audiences for our advertising campaigns. Meta may collect or receive information from our Website through the Meta Pixel and use that information to provide measurement services and targeted ads. In general, we use personal information that we collect from you to provide our Services, operate our business, and provide information that you request from us. This includes the following uses and purposes:

Create and administer your account.

Provide, operate, improve, maintain, and protect our Services.

Store, transcribe, and analyze Chatbot information to provide you with the Services.

Process your payments, fulfill your orders, send notifications to you related to your account, purchases, returns, exchanges or other transactions, to create, maintain and otherwise manage your account, to arrange for shipping, facilitate any returns and exchanges and to enable you to post reviews (if applicable).

Provide you with technical and other support.

Facilitate actions that you take in the Services.

Send you Services and company updates, marketing communication, and other information about Bestform, our Services, and products and services of third parties, that we think you may be interested in.

Conduct research and analysis, and monitor and analyze trends and usage.

Facilitate your participation in rewards and discount programs that we may offer.

Enhance or improve user experience, our business, and our Services, including the safety and security thereof.

Personalize our Services to you.

Communicate with you and respond to inquiries, including to improve our responses.

Suggest resources and information that we think you might be interested in.

Facilitate your participation in promotions and sweepstakes that we may offer.

Send you push notifications through the App.

Operate our business and perform any other function that we believe is necessary to protect the security or proper functioning of our Services.

As necessary to comply with any applicable law, regulation, subpoena, legal process, or governmental request.

Enforce contracts and applicable Terms of Use, including investigation of potential violations thereof.

Detect, prevent, or otherwise address fraud, security or technical issues.

Protect against harm to the rights, property or safety of Bestform, our Services, our users, customers, or the public as required or permitted by law.

Additionally, we use algorithms and machine learning models for personalization, safety and security, and to prevent abuse or other Terms of Use violations, including when you interact with our Chatbot. For example, our algorithms and machine learning models take into account the conversations you are having with our Chatbot to improve the responses we generate.

Like most companies, we share information in certain circumstances with third parties through operation of our Services and our business. Below we explain when that happens.

Other Users and Third Parties

Certain features of our Services may allow you to share information with other users or make information publicly available. For example, if you participate in community features, post reviews, or interact with other users through our Services, certain information about you (such as your username or profile information) may be visible to other users. Please exercise caution when sharing information through these features and do not share any information you do not want to be publicly accessible.

Service Providers

We use third parties to assist us with operating our business and providing our Services, such as our technology vendors that help us maintain our Services, partners that assist us with our marketing and communication, our payment processors, our e-commerce providers, such as Shopify, and service providers that help us to prevent and detect fraud. These service providers will have access to your information in order to provide their services to us.

Chatbot

Our Chatbot leverages certain artificial intelligence and deep learning platforms, algorithms, tools and models ("AI Services") to collect, analyze, and respond to user prompts and requests with automated advice. When you use the Chatbot, we may share any content or other information you provide to the Chatbot with the AI Services in order to complete your request.

Shopify

Our Website and certain e-commerce features of our Services are powered by Shopify Inc. ("Shopify"). When you browse our Website or make a purchase, Shopify collects certain information from you, including your name, billing and shipping address, payment information, email address, phone number, and IP address. Shopify uses this information to fulfill your orders, process payments, and provide its services to us. As Directed By You and With Your Consent

Except as otherwise provided in this Policy, we share information with companies, organizations or individuals outside of Bestform only at your direction or when we have your consent to do so.

Legal Proceedings

We may share information with third party companies, organizations, governmental authorities, or individuals outside of Bestform if we have a good-faith belief that access, use, preservation or disclosure of the information is reasonably necessary to:

Meet any applicable law, regulation, subpoena, legal process or governmental request;

Enforce a contract, including but not limited to any applicable Terms of Use, including investigation of potential violations thereof;

Detect, prevent, or otherwise address fraud, security or technical issues; or

Protect against harm to the rights, property or safety of Bestform, our users, customers or the public as required or permitted by law.

Sale or Merger

We may share information about you as part of a merger or acquisition. If Bestform is involved in a merger, asset sale, financing, liquidation or bankruptcy, or acquisition of all or some portion of our business to another company, we may share your information with that company before and after the transaction closes. In such a case, unless permitted or otherwise directed by applicable law, your information would remain subject to the terms of the applicable privacy policy in effect at the time of such transfer.

Aggregate Information

We may de-identify or aggregate any information, including personal information, that we collect from or about you so that you are not identified as an individual, and use and disclose that information to third parties without restriction, including for commercial purposes. We may also provide aggregate usage information and data to third parties (or allow third parties to collect that information from you), who may use such information to understand how often and in what ways people use our Services. However, we never disclose aggregate usage or de-identified information to a third party (or allow a third party to collect such information) in a manner that would identify you as an individual person.

We strive to provide you with choices with respect to your personal information. Also, remember, you can opt not to disclose certain information to us - but keep in mind some information may be needed to create an account or to take advantage of some of the features of our Services.

Deletion, Modification, and Access to Your Information

We will respond to your request within a reasonable timeframe and in accordance with applicable law. Please note that we may need to retain certain information as required by law or for legitimate business purposes.

Marketing

You may unsubscribe from our marketing communications at any time by following the "unsubscribe" link at the bottom of any such communication. Most promotional communications will also offer recipients choices about receiving additional messages.

How Long We Keep Your Information

Generally, we keep your information for as long as you tell us to, or otherwise as long you have an account with us, as long as we need it to provide our Services.

We may be required to retain information to comply with certain legal obligations.

We may need to retain your information to prevent harm, investigate possible violations of our Terms of Use or other policies, investigate reports of abuse, or protect ourselves or others.

In some cases we may need to comply with legal requirements to store your information, which prevents us from deleting it. For example, if we receive a notice from a court, if we get reports of abuse or other or policy or terms violations, or if your account, content created by you, or content created with other users is flagged by others or our systems for abuse or other terms or policy violations.

If you are a California resident, you have certain rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act ("CCPA/CPRA"). This section describes your rights and how to exercise them.

Right to Know. You have the right to request that we disclose the categories and specific pieces of personal information we have collected about you, the categories of sources from which we collected your personal information, the business or commercial purposes for which we collected or sold your personal information, and the categories of third parties with whom we shared your personal information.

Right to Delete. You have the right to request that we delete your personal information that we have collected from you, subject to certain exceptions.

Right to Correct. You have the right to request that we correct inaccurate personal information that we maintain about you.

Right to Opt-Out of Sale or Sharing. You have the right to opt out of the sale or sharing of your personal information. We do not sell your personal information in exchange for monetary consideration. However, we may share certain information (such as online identifiers and browsing activity) with advertising partners, including through technologies like Meta Pixel, which may constitute a "sale" or "sharing" under the CCPA/CPRA. Right to Non-Discrimination. We will not discriminate against you for exercising any of your CCPA/CPRA rights. We will not deny you goods or services, charge you different prices or rates, provide you a different level or quality of goods or services, or suggest that you may receive a different price or rate or different level or quality of goods or services.

How to Exercise Your Rights. To exercise your rights under the CCPA/CPRA, please contact us at privacy@getbestform.com. We may need to verify your identity before processing your request. We will respond to your request within 45 days, as required by law. If we need additional time, we will notify you of the extension and the reason for it.

Authorized Agents. You may designate an authorized agent to submit requests on your behalf. We may require that you provide the authorized agent with written permission and that the authorized agent verify their own identity.

Categories of Personal Information Collected. In the preceding 12 months, we have collected the following categories of personal information: identifiers (such as name, email address, phone number); commercial information (such as purchase history); internet or other electronic network activity information (such as browsing history and interactions with our Services); geolocation data (general location); audio, electronic, visual, or similar information (such as photos you provide); professional or employment-related information (if provided); inferences drawn from the above (such as preferences and behavioral patterns); and sensitive personal information (such as health-related information you provide to us).

Our Services are not directed at children under 18, and we do not knowingly collect information from children under 18. If you are under 18, please do not attempt to use our Services or send any information about yourself to us.

Our Services may contain links to other websites and services operated by third parties, and may include social media features such as Facebook, Instagram, X (formerly Twitter), and TikTok buttons or links. These third-party websites and services may collect information about you if you click on a link or visit those websites or services, and the social media sites may automatically record information about your browsing behavior every time you visit a website that has a social media button. Your interactions with these features and third parties are governed by the privacy policy of the third party, not by this Policy.
